Terms & Conditions

1. Registration

Clients interested in our nanny services must complete the online Registration Form to be accepted as Clients. Alternatively, clients may sign the Terms and Conditions document and return it to us before being accepted onto our books. By filling out the online registration form or signing the physical document, clients confirm their acceptance of the Terms & Conditions.

1. Booking and Payment

A. To secure the booking of a nanny, the Client must pay a non-refundable deposit to hold the booking. This deposit is only refundable in the event that Elisabet cannot provide a replacement nanny due to unforeseen circumstances preventing the nanny from commencing the booking.

B. Clients are responsible for paying the nanny's fees at the end of each shift.

1. Nanny's Obligations

A. Nannies operate as an introductory service, and we want to clarify that we do not assume responsibility or liability for any incidents or mishaps that may occur as a result of the introduction. Although each nanny undergoes a thorough screening process by Elisabet, we cannot be held liable for any issues arising from the nanny's employment. It is crucial to note that nannies introduced through our service are responsible for their self-employment status.

B. In cases where the family assumes the responsibility of employing nannies directly, it is the nanny's responsibility to ensure that the family establishes a proper employment contract if they are not self-employed. We want to emphasize that we serve just as an introductory service, facilitating connections between nannies and clients. However, the ultimate accountability for the employment arrangement, including contractual agreements, rests with the nanny.

1. Rights & Obligations of Elisabet

A. We operate as a matchmaking service that connects Clients with potential nanny Candidates.

B. We make reasonable efforts to assess the suitability of Candidates for introduction to Clients by obtaining references. However, the ultimate responsibility for evaluating the suitability of a Candidate for employment lies with the Client.

1. Cancellation and Termination

A. If a Client withdraws an offer of confirmed employment or cancels a confirmed booking before the nanny's start date, a cancellation fee of 25% of the placement fee will be payable to us. Payment is due within seven working days from the date of the invoice. If a Client cancels a confirmed booking during the nanny's employment, the paid fee remains non-refundable, and one week's salary is payable to the nanny to compensate for the loss of earnings.

B. Should a nanny cancel a confirmed and paid booking, we will offer a replacement nanny free of charge. If the Client chooses not to accept the replacement nanny or prefers not to use our services for finding a replacement, only 50% of the paid agency fee will be refunded.

1. Copyrights

All materials found within the Montessori Nannies website, including text and images, are protected by copyright and may not be copied, reproduced, republished, downloaded, posted, broadcast, or transmitted in any way without the express permission of Montessori Nannies.

1. Legal

These terms and conditions are governed by the laws of Spain, and any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Spain. By engaging with us and reading these terms and conditions, the Client agrees to be bound by this legally binding contract.

1. Amendments

We reserve the right to modify or add to these Terms and Conditions without prior notification. Any changes will be posted on the Montessori Nannies website, and it is the Client's responsibility to review these Terms and Conditions regularly. Continued use of the Agency's services after any changes are made constitutes acceptance of the updated terms.

1. About Our Selection Process

The selection process guarantees that the profile of each Montessori nanny fits with our Montessori philosophy and holistic education. We thoroughly review the references of our nannies and conduct a rigorous verification process of their personal information and professional references. Additionally, we require our nannies to provide Criminal Background Checks (CBR) and hold a Pediatric First Aid certificate.

1. Late Bookings

We are here to serve you and will make every effort to accommodate last-minute bookings. However, please note that all bookings placed less than 24 hours in advance cannot be guaranteed and will have an extra cost of 2 Euros per hour.

1. Selection and Engagement of Babysitters

We carefully interview, check references, and verify police records to ensure babysitters meet high standards. Parents make the final decision to employ a babysitter and must fulfill legal obligations. Insurance and Liability. We serve as an introduction service and don't employ babysitters. Babysitters introduced by us are responsible for their insurance and tax matters.

1. Parental Responsibilities

Parents must:

• Claim on their insurance for any incidents involving children or property under a babysitter's care.

• Understand Elisabet is not liable for accidents or losses during babysitting.

1. Private Medical and Travel Insurance

Parents should obtain private medical and travel insurance. We hold no responsibility or liability for incidents involving children.

​

1. Disclosure of Health and Safety Risks

Parents must inform babysitters and the agency of any health or safety concerns. This ensures a safe environment. Providing Nannies. We aim to provide the same nanny for the entire booking. However, in cases like illness, a last-minute replacement may be provided without canceling the booking or issuing refunds.

1. Cancellations by Us

The reservation fee is non-refundable, except if we cannot provide a sitter for a confirmed booking. In such cases, the agency will return any deposit paid.

​

1. Child's Illness during Booking

If a child falls ill during a booking, the babysitter may cancel part or all of it. No refunds will be given in such cases.

1. By confirming your booking through www.montessorinannies.org the parent is deemed to have agreed and accepted all of the above terms and conditions.
